This page constitutes public notice of ResidentAM Inc.'s intellectual property rights under the Lanham Act (15 U.S.C. § 1051 et seq.), the Defend Trade Secrets Act (18 U.S.C. § 1836), and applicable state law. Use of any ResidentAM mark, methodology, or proprietary system without written authorization is prohibited and will be enforced.
1Ownership of Marks
ResidentAM Inc. ("ResidentAM," "the Company," "we," or "us") is the sole and exclusive owner of the following registered and common-law trademarks, service marks, and proprietary designations used in connection with community association management technology and services:
A proprietary multi-dimensional scoring methodology for evaluating the operational, financial, governance, compliance, and resident-engagement health of community associations. The CHIS Score algorithm, weighting framework, dimensional definitions, and grading scale are confidential trade secrets of ResidentAM Inc.
A proprietary risk-assessment and operational-performance scoring system used to evaluate governing document compliance, board decision quality, legal exposure, and management process integrity in community associations. The C.R.OpS scoring system, risk taxonomy, and evaluation criteria are confidential trade secrets of ResidentAM Inc.
The category designation and platform brand for ResidentAM's integrated community association operating system. AOP Platform™ refers to the unified technology infrastructure combining operations management, financial visibility, compliance tracking, and intelligent automation for HOA and COA management.
The ™ symbol is used to assert common-law trademark rights in these marks. Applications for federal registration may be pending. All rights not expressly granted are reserved.
2Trade Secret Protections
The following constitute confidential, proprietary trade secrets of ResidentAM Inc. and are protected under the Defend Trade Secrets Act of 2016 (DTSA), 18 U.S.C. § 1836, the Delaware Uniform Trade Secrets Act (6 Del. C. § 2001 et seq.), and the trade secret laws of all applicable jurisdictions:
CHIS Score™ Methodology
- The eight-dimensional scoring framework and dimension definitions
- Dimensional weighting percentages and calculation formulas
- Threshold values, including the Fannie Mae delinquency benchmark integration, Social Security stress test parameters, and FHA investor-ratio thresholds
- The grading scale and grade-to-score mapping (A+ through F)
- Data inputs, normalization methods, and output interpretation guidelines
- Any machine learning models, training data, or AI enhancements applied to scoring
C.R.OpS™ Scoring System
- The risk taxonomy, category definitions, and weighting methodology
- Document review criteria, legal-risk scoring rubrics, and SOP compliance evaluation logic
- Board decision analysis frameworks and outcome-prediction models
- Integration logic connecting C.R.OpS outputs to operational recommendations
AOP Platform™ Architecture
- Platform source code, database schema, API design, and data models
- Automation logic, trigger rules, and workflow orchestration systems
- AI prompt engineering, model routing configurations, and context management systems
- Integration architectures connecting third-party services to the platform
ResidentAM Inc. takes active steps to maintain the secrecy of the above information, including contractual confidentiality obligations, access controls, employee non-disclosure agreements, and technical security measures. Disclosure, misappropriation, or reverse engineering of any ResidentAM trade secret is a federal crime and a civil tort subject to significant damages.

4Prohibited Uses
The following acts are expressly prohibited without prior written authorization from ResidentAM Inc.:
- Using the names CHIS Score, C.R.OpS, AOP Platform, or any confusingly similar name, abbreviation, or designation in connection with any product, service, software, marketing material, or business offering
- Representing or implying that any product or service is affiliated with, endorsed by, or derived from ResidentAM Inc. or its proprietary systems
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, algorithm, methodology, or scoring logic of any ResidentAM proprietary system
- Copying, reproducing, scraping, or otherwise extracting content, data models, workflows, or architectural designs from the ResidentAM platform
- Creating a competing product or service that is substantially similar to, or derived from, ResidentAM's proprietary methodology, scoring systems, or platform architecture
- Disclosing, transmitting, or selling any ResidentAM confidential information obtained through authorized platform access, employment, or contractual relationship
- Using ResidentAM trademarks in domain names, social media handles, advertising, or search engine marketing without written consent
- Incorporating ResidentAM marks into any third-party product name, presentation, or marketing in a manner that suggests sponsorship, affiliation, or endorsement
5Consequences of Infringement
ResidentAM Inc. actively monitors for unauthorized use of its intellectual property and will pursue all available legal remedies against infringers. Depending on the nature and severity of the infringement, ResidentAM may seek any or all of the following:
Civil Remedies
- Injunctive relief — Court orders requiring immediate cessation of infringing activity, including temporary restraining orders and preliminary injunctions where irreparable harm is threatened
- Actual damages — Recovery of all provable economic losses caused by the infringement, including lost profits, lost business opportunities, and diminished brand value
- Disgorgement of profits — Recovery of all profits the infringer derived from the unauthorized use of ResidentAM's intellectual property
- Statutory damages — Under the Lanham Act, up to $2,000,000 per mark per counterfeit use for willful infringement; under the Copyright Act, up to $150,000 per work for willful infringement
- Exemplary damages — Under the DTSA and Delaware trade secret law, up to two times actual damages for willful and malicious misappropriation of trade secrets
- Attorney's fees and costs — In exceptional trademark cases (Lanham Act § 35(a)) and willful trade secret cases, ResidentAM may recover all attorney's fees and litigation costs from the infringer
- Destruction of infringing materials — Court-ordered destruction or surrender of all products, materials, or content incorporating misappropriated intellectual property
Criminal Liability
- Trade secret theft — Under the Economic Espionage Act (18 U.S.C. § 1832), theft of trade secrets for commercial advantage is punishable by fines up to $5,000,000 and imprisonment up to 10 years per count
- Economic espionage — Where trade secrets are misappropriated for the benefit of a foreign government or entity, penalties under 18 U.S.C. § 1831 include fines up to $15,000,000 and imprisonment up to 15 years
- Computer fraud — Unauthorized access to ResidentAM's systems to obtain proprietary information may constitute a federal crime under the Computer Fraud and Abuse Act (18 U.S.C. § 1030)
- Trademark counterfeiting — Willful use of counterfeit marks in commerce under 18 U.S.C. § 2320 may result in criminal prosecution with fines and imprisonment
ResidentAM Inc. does not issue warnings before initiating legal action in cases of willful infringement, misappropriation, or competitive harm. We maintain detailed records of our intellectual property use, development history, and market presence. Any party engaged in infringing activity should cease immediately and consult with legal counsel.
6Permissible Uses & Nominative Fair Use
The following limited uses of ResidentAM marks are permitted without prior written consent, provided they do not suggest sponsorship, endorsement, or affiliation:
- Editorial reference — Identifying ResidentAM products by their proper names in news articles, academic research, industry analysis, or comparative reviews, provided the marks are used accurately and the ™ symbol is included on first use
- Community member reference — Residents, board members, or community managers who use the ResidentAM platform may identify it as such in communications relevant to their community
- Integration partners — Parties who have executed a written integration or partnership agreement with ResidentAM Inc. may reference the marks as permitted by that agreement

7Third-Party Marks
All third-party product names, company names, trademarks, and logos referenced on this website or in ResidentAM platform documentation are the property of their respective owners. Reference to third-party marks does not imply affiliation with or endorsement by those parties. Xero® is a registered trademark of Xero Limited. Microsoft®, Teams®, and SharePoint® are registered trademarks of Microsoft Corporation. Gusto® is a registered trademark of Gusto, Inc. All other marks are property of their respective owners.
8Reporting Infringement
If you have knowledge of, or suspect, unauthorized use of ResidentAM's intellectual property — including trademark infringement, trade secret misappropriation, copyright violation, or platform reverse engineering — please report it immediately. ResidentAM investigates all reports promptly and maintains confidentiality of reporting parties where possible.

9Governing Law & Jurisdiction
This notice and any disputes arising from ResidentAM's intellectual property rights shall be governed by and construed in accordance with the laws of the State of Delaware and applicable federal law, without regard to conflict-of-law principles. ResidentAM reserves the right to bring suit in any court of competent jurisdiction, including federal district courts where federal claims are asserted.
For trade secret claims, ResidentAM may elect to proceed under the Defend Trade Secrets Act (18 U.S.C. § 1836) in federal court, which provides for ex parte seizure orders, injunctive relief, damages, exemplary damages, and attorney's fees.
